Texas Event Restroom Requirements

A statewide guide to Texas Health and Safety Code Chapter 751 mass gatherings, the sanitation standards in 25 TAC 265.3, and how those rules differ from ordinary city event permits.

Quick Answer

Texas has a specific mass-gathering statute for large events held outside municipality limits. Those gatherings need a county-judge permit filed at least 45 days ahead, and the state sanitation standards in 25 TAC 265.3 include a maximum of 50 persons per toilet seat plus handwashing near toilet locations. Most city park festivals and street events follow local city or Township rules instead. This guide sticks to the primary statute and rule text and does not invent local ratios.

What This Guide Covers

This page explains the statewide framework in Texas Health and Safety Code Chapter 751 (the Texas Mass Gatherings Act) and the minimum sanitation standards in 25 Texas Administrative Code §265.3. It does not replace legal advice, and it does not invent city-specific toilet ratios. For Houston-area or Austin-area logistics, use the metro event guides linked below.

Chapter 751 Definition

Under §751.002, a "mass gathering" means a gathering:

  • held outside the limits of a municipality;
  • that attracts or is expected to attract more than 2,500 persons, or more than 500 persons if 51 percent or more may reasonably be expected to be younger than 21 years of age and it is planned or may reasonably be expected that alcoholic beverages will be sold, served, or consumed at or around the gathering; and
  • at which the persons will remain for more than five continuous hours, or for any amount of time during the period beginning at 10 p.m. and ending at 4 a.m.

If your event is inside city limits, Chapter 751 generally does not define it as a mass gathering, even if attendance is large. Follow the city or Township process for that property instead.

Permit Requirement & Timing

Section 751.003 states that a person may not promote a mass gathering without a permit issued under Chapter 751. Section 751.004 requires the promoter to file a permit application with the county judge of the county where the gathering will be held at least 45 days before the gathering date. Among other items, the application must include a description of each step the promoter has taken to ensure that minimum standards of sanitation and health will be maintained during the mass gathering.

25 TAC 265.3 Sanitation Standards

For mass gatherings covered by the state rule, §265.3 includes these restroom-related minimums:

Toilet facilities

Separate for each sex, plainly marked "Men" and "Women", at no more than 50 persons per toilet seat, and designed to shield occupants from public view.

Portable toilets

If provided, waste must be collected often enough to preclude overflow and disposed of without creating a health hazard or nuisance.

Handwashing

Handwashing and drying facilities must be provided in the vicinity of each toilet building or location, with wastewater collected in holding tanks or subsurface absorption fields.

Related standards

The same section also covers water supply, solid waste, vector control, noise, food sanitation, medical aid, and final site cleanup. Read the full rule for those topics.

These standards are the state baseline for permitted mass gatherings. Counties may ask for more detail on the application, and promoters still need to meet any other applicable health or safety rules.

City Events vs. State Mass Gatherings

Usually local city / Township rules

  • Festivals and races inside city limits
  • Park events on municipal or Township property
  • Street closures and downtown events
  • Private weddings on private land (venue / HOA rules)

Check Chapter 751

  • Large gatherings outside municipality limits
  • Attendance and duration thresholds in §751.002
  • County-judge permit at least 45 days ahead
  • State sanitation standards in 25 TAC 265.3

Practical Planning Notes

→Decide early whether the site is inside or outside municipal limits.
→If Chapter 751 may apply, contact the county well before the 45-day application deadline.
→Put restrooms and hand wash stations on the site plan the county or city will review.
→For ordinary city events, follow that city's published special-event or park process.
→Price and service terms vary by provider; use the Texas cost guides for cost factors only.
